AGREEMENT : Flute Tuition

PUPIL (or if the Student is under 18, the Student's parent or guardian)

CONDITIONS

1. INDIVIDUAL & SHARED LESSONS

a. The Student will be offered THIRTY SIX (36) individual lessons each academic year, which the Teacher will give the tuition to the Student in blocks of lessons called Terms. The Teacher will give the individual lessons at the location specified overleaf and at the times and dates as notified to the Student (or the Student’s parent or guardian) in writing and the Teacher will reserve this time slot for the Student.

b. A Term commences and ends on the dates stated in the invoice issued by the Teacher to the Student (or the Student’s parent or guardian where appropriate). Note that Term dates are not always in-line with the LEA term dates.

c. Lessons will take place on public holidays or outside of the Term only by prior agreement between the Teacher and the Student (or the Student’s parent or guardian).

 

2. GROUP LESSONS

a. In addition to individual lessons the Student will participate in NINE (9) group lessons each academic year. Lessons will be a minimum of FORTY FIVE (45) minutes in length.

b. Group lesson times and locations will be confirmed in writing by the Teacher in advance of the lesson.

 

3. PERFORMANCE OPPORTUNITIES

a. Performance is considered an integral part learning an instrument. Therefore, attendance at all performing events is mandatory unless the Student is ill or has agreed in advance not to attend the performance.

b. Regular performance develops stage presence, musicality, builds confidence, teaches concert etiquette and

provides inspiration for all Students.

c. Students will be invited to perform in concerts but not necessarily all. This is no reflection on the Student’s progress or standard.

d. Students will perform a polished piece as a solo. There may be group pieces or special ensembles as well.

e. Before each performance additional rehearsals may be scheduled. Attendance at these rehearsals is also

mandatory.

 

4. FEES & SUBSCRIPTIONS

a. Lesson fees include an element for both individual and group lessons.

b. Lesson fees applicable at the start of this Agreement will be confirmed in writing in the first invoice issued by the Teacher to the Student (or the Student’s parent or guardian where appropriate).

c. The invoice amount is calculated on the basis of the total number of individual and group lessons offered over an academic year divided by the number of Terms in the academic year, with the exception of items detailed under Condition 4(e) which must be invoiced at set times.

d. The Teacher may increase the tuition fees from time to time and will give written notice of such an increase to the Student (or the Student’s parent or guardian where appropriate) by no later than the end of the Term preceding the Term when the increase takes effect.

 

5. PAYMENT

The Student (or the Student’s parent or guardian) will receive an invoice at the end of each Term for the following Term. This invoice must be paid in full by the end of week TWO (2) of the Term as given in the invoice.

 

6. LESSON CANCELLATIONS AND RE-SCHEDULED LESSONS

a. Individual Lesson:

1. If a Student (or the Student’s parent or guardian) cancels a lesson with more than FORTY EIGHT (48) hours notice, the lesson will be re-scheduled to another date.

2. A Student is allowed ONE (1) re-scheduled lesson per Term. Any subsequent lessons cancelled by the Student (or the Student’s parent or guardian) will not be re-scheduled and will be charged.

3. If a Student fails to attend a lesson, or a Student (or the Student’s parent or guardian) cancels a lesson with less than FORTY EIGHT (48) hours notice, or if a Student fails to attend a re-scheduled lesson, or a Student (or the Student’s parent or guardian) cancels a re-scheduled lesson, the lesson will be charged.

4. If the Teacher cancels a lesson, the lesson will be re-scheduled to another date. If this is not possible, any fee already paid will be refunded or used to pay for a future lesson.

 

b. Shared Lesson:

1. Each Student is deemed to have paid for a pro rata proportion of the total lesson duration.

2. If a Student (or the Student’s parent or guardian) cancels a lesson with more than FORTY EIGHT (48) hours notice, the lesson will be re-scheduled to another date, equal to their pro rata proportion of the original group lesson. The original lesson will remain for the other Students of the group and will have a pro rata reduction in duration. It is the responsibility of the Student (or the Student’s parent or guardian) cancelling the lesson to ensure this reduction in duration is communicated to the remaining Students.

3. A Student is allowed ONE (1) re-scheduled lesson per Term. Any subsequent lessons cancelled by the Student (or the Student’s parent or guardian) will not be re-scheduled and will be charged.

4. If a Student fails to attend a lesson, or a Student (or the Student’s parent or guardian) cancels a lesson with less than FORTY EIGHT (48) hours notice, or if a Student fails to attend a re-scheduled lesson, or a Student (or the Student’s parent or guardian) cancels a re-scheduled lesson, the lesson will be charged. Any remaining Students of the group will be taught for the original duration of the group lesson.

5. If the Teacher cancels a lesson, the lesson for the whole group will be re-scheduled to another date. If this is not possible, any fee already paid will be refunded or used to pay for a future lesson.

 

c. Group Lesson:

1. If a Student fails to attend a group lesson, the lesson will be charged and will not be made-up, rearranged or refunded.

2. If the Teacher cancels a group lesson, the lesson will be re-scheduled to another date or will be refunded.

 

 

7. ADDITIONAL LESSONS

Additional lessons may be scheduled during holiday periods or at any other time by mutual agreement.

 

 

8. PHOTO/VIDEO/AUDIO PERMISSION

On occasions the Teacher may take photographs/video/audio recordings of the Student for the purpose of training and promotion. These photographs/video/audio recordings may be made during lessons, workshops or performances.

 

 

9. TERMINATION OF LESSONS

a. This Agreement may be ended by mutual consent at any time by both signatories to it signing and dating a written statement to that effect.

b. Either signatory to this Agreement may terminate the Agreement by giving at least SIX (6) weeks notice in writing to the other signatory. If the Teacher gives notice to terminate tuition in accordance with this Condition the Teacher will continue to provide lessons until the end of the notice period.

 

 

10. FAILURE TO GIVE NOTICE

a. Unless terminated under Condition 9 above, this Agreement shall continue from Term to Term.

b. If the Student (or the Student’s Parent or Guardian) fails to give full notice to terminate this Agreement in accordance with Condition 9(b) above and the signatories have not agreed to terminate the Agreement in accordance with Condition 9(a) above, the following charges will be made in lieu of notice: 100% of the fees due for the notice period required under Condition 9(b).

c. If the Student stops attending lessons while a Term is ongoing, the Student (or the Student’s Parent or Guardian) is not entitled to a refund of any fees paid for that Term. The Student is entitled to attend any lessons paid for.

d. If the Teacher stops lessons without giving the correct notice specified in Condition 9(b) above the Teacher shall refund any fees already paid for any lessons not given.

 

11. CONDUCT

If the Teacher, using their reasonable discretion, feels unable to continue tuition on account of conduct by the Student or anyone connected with the Student which makes it unethical or unsafe to continue teaching the Student, the fees for any outstanding lessons will not be refundable.

 

12. CHANGES

a. Any changes to the terms of this Agreement must be confirmed in writing and signed and dated by both the Teacher and the Student (or the Student’s parent or guardian).

b. If the Teacher chooses to waive any right or remedy under this Agreement or otherwise (for example, if the Teacher chooses to waive fees for any lessons which the Student (or any other Student) does not attend) this shall not mean that they must do so in future or that they waive any other rights or remedies, unless agreed in writing in accordance with Condition 10(a) above.

 

13. GOVERNING LAW AND JURISDICTION

This Agreement shall be subject to the laws of the jurisdiction of the location for the lessons (specified above) and the signatories to this Agreement agree that any dispute relating to the subject matter of this Agreement shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.

 

14. GENERAL

a. The Student (or the Student’s parent or guardian) agrees to pay for any music/strings/reeds/repairs etc. required by the Student and provided by the Teacher.

b. The Student (or the Student’s parent or guardian) will be responsible for any loss or damage incurred to any instrument, accessory or music loaned by the Teacher to the Student. Such items will be returned on request to the Teacher.

c. The Student (or the Student’s parent or guardian) undertakes not to make photocopies of any music.

d. The Student will not enter any examination, festival, competition or otherwise perform in public without first consulting the Teacher. The Teacher will not enter the Student for any examination, festival, competition or public performance without the approval of the Student (or the Student’s parent or guardian). The Student (or the Student’s parent or guardian) will pay any entry fees for said events.

e. The Student (or the Student’s parent or guardian) is responsible for the insurance of the Student’s instrument.

f. In the interests of the Student’s well-being whilst in the Teacher’s care, the Teacher must be informed of any medical or other condition affecting the Student.

g. Please turn off your mobile phone whilst in the studio, EXCEPT in an emergency. Please ask before using the

phone.

h. All lessons will begin on time and end on time. If you are late, you will be given whatever time remains. Students should arrive promptly at the scheduled lesson time, (ideally five minutes early) in order to receive a full lesson.

i. The Teacher encourages all Students to observe other Students lessons. Try to arrive at your lesson a few minutes early, or stay late. Significant learning takes place simply by watching and listening to someone else. If you do arrive early, feel free to quietly enter the studio, and try not to disrupt the lesson in progress.

j. As you enter and exit the studio, please do so QUIETLY and please be courteous.

k. As a Student’s parent or guardian, if you have issues you wish to discuss with the Teacher, especially pertaining to the Students practice or progress, please do not bring them up during the lesson time. Please find another time when the Student cannot hear you and give me a call, or preferably email me.

The Conditions set out above will apply to this Agreement. When this Agreement has been signed by both the Teacher and the Student or, if the Student is under 18 years of age, the Student’s parent or guardian, it will constitute a legally binding contract between the signatories.

The Agreement will remain in force continuously from Term to Term unless terminated in accordance with Condition 9.

Note: As a member of the Incorporated Society of Musicians, the Teacher is fully insured for public liability. It is important to note that while a Teacher will use his or her best endeavours to ensure the Student makes satisfactory progress, this cannot be guaranteed. In particular, careful regular practice as advised by the Teacher is a pre-requisite of success on a musical instrument.

I (Student or, if the Student is under 18, the Student's parent or guardian) accept the offer of tuition on the conditions set out herein and agree to be bound by them until termination of this Agreement.
